Civil Law/Common Law Co – Mediation – the Lux – Alcantara SSS (6th Sense to Success) Approach

OFFERING:

Jonathan S. Lux (JSL) and Jose Maria Alcantara (JMA) (CVs attached) are two very experienced mediators who have worked closely together over a number of years and can offer a co-mediation service where their combined cost of 1+1 = < 2. Drawing upon their combined experience, they have distilled that the ability of 2 Mediators to brainstorm at critical points in the mediation leads to a higher probability of a successful mediation, allowing the parties to put the dispute behind them.

✓ In the increasing number of cases where there is a civil law party on one side and a common law party on the other, each may feel more at home having a mediator from his ‘cultural’ background by his side.

Experience:
✓ JSL was a long-standing partner in a leading international commercial law firm with its head office in London specialising in shipping, insurance, international trade and energy. He is a Barrister, Mediator and Arbitrator, and receives regular appointments as mediator and arbitrator in relation to both domestic and international commercial disputes.

✓JMA was the founder and main partner of the leading domestic and international maritime law firm AMYA. He is an arbitrator since 1982 and an international shipping mediator since 2006, founder of the IMCAM Panel, in London. He receives appointments in relation to commercial and shipping disputes.

Languages:
✓ JSL is fluent in English, French and German.
✓ JMA is fluent in Spanish, English and French.

Lessons from the last 2 years:
✓ Courtesy of Covid, both now have significant experience of conducting virtual mediations using Zoom and other platforms. They can therefore offer virtual, hybrid or physical hearings, whichever may be decided best for the particular case.

COST:

‘Standard’ Offering:
✓ JSL and JMA will co-mediate for 75% of their combined standard rate (as per the attached table).

‘Contingency’ Offering:
✓  If the parties so agree, JSL and JMA will co-mediate for 50% of their combined standard rate if the mediation is UNSUCCESSFUL or at 100% of the full standard rate (Full Offering) if the mediation is SUCCESSFUL (as per attached table).
