MEDIATION IN FRANCE

Mediation was first governed by law in France in 1995 and has become a highly valued means of settling disputes. Not only can mediation bring damaging disagreements to an end, but it can also preserve business relations and avoid lengthy and time consuming court cases.

Mediation is defined in France (by the Ordinance of 2011) as a:
‘structured process whereby two or more parties attempt to resolve a dispute by themselves to reach an agreement on the settlement of their dispute with the assistance of a mediator, chosen by the parties or named by the judge.”

During mediation, the mediator acts as a neutral third party. The mediator does not take sides or give advice – but supports the parties involved to explore solutions that can bring their case to a mutually beneficial settlement.

Mediation services are used in France to settle all areas of law including civil, commercial and employment law disputes. In some cases, mediation is directed by the court and is referred to as ‘court-annexed Mediation’ but it still has the same objective of bringing the parties involved to a successful agreement that avoids further court procedures.

Our founder Jonathan Lux obtained his Master’s degree in law (DES) from the university of Aix-Marseille and his fluency in French means he is well placed to provide mediation services in France or to mediate international cases which involve one or more French parties. Jonathan is able to communicate with parties from different countries in their own language thereby avoiding misunderstandings in the often tense discussions that occur in international and commercial cases.

Despite the fact that the parties may be from different countries and at some geographical distance, mediation can be fast, efficient and cost-effective. A binding settlement can be achieved in just one day, even if a dispute has been running for a significant period of time.
